The Attorney General’s Office (FGR) and the state of Nayarit recovered 9,619,454 square meters of land on the Riviera Nayarit coast, whose patrimonial value is estimated at 50 billion pesos. These assets were improperly seized from the state, and the former PRI governors Ney González (2015-2011), a fugitive from justice, and his successor Roberto Sandoval (2011-2017), currently imprisoned and serving a seven-year sentence for document forgery, are involved.

Also as part of the results of the mega-operation Nuevo Nayarit, the FGR secured 359 bank accounts with an amount exceeding 7 billion 213 million pesos, belonging to 45 legal entities and 82 individuals.

Most of the recovered goods are located in Nuevo Vallarta, Bucerías, La Cruz de Huanacaxtle, Sayulita, and Compostela.

At a press conference, Cristina Reséndiz Durruti, the Attorney General’s Office’s Special Prosecutor for Competition Control, stated that in 2023 they requested an arrest warrant for Ney González for money laundering, and that the investigations into the Sandoval case are ongoing. She also mentioned that there are open investigations against family members and companies of the former governors.

He pointed out that there is an Interpol red notice against Ney González, as he is accused of the mega-fraud committed against the Bahía de Banderas Trust (Fibba) during his administration.

He also has two other outstanding arrest warrants for embezzlement, document forgery, abuse of power, influence peddling, and fraudulent administration.

“We have opened several investigations into crimes such as money laundering, influence peddling, violations of the amparo law, and obstruction of justice, among others. In these cases, various investigative actions have been carried out, including the seizure of properties, the use of judicially controlled investigative techniques, and the transfer of information by the Ministry of Finance and Public Credit,” the prosecutor said.

“An arrest warrant has been requested from the Judiciary against a former governor who has been in justified preventive detention since 2021 and who is being prosecuted for operations with resources of illicit origin, and real estate assets were seized.”

In this regard, Petronilo Díaz Ponce Medrano, Attorney General of Nayarit, pointed out that they inspected public notaries linked to the illicit operations where alterations were detected in registry books and official documents, confirming the existence of a carefully planned network to simulate legal acts and deprive the state of valuable assets.

“This investigation was complex and far-reaching. It comprises approximately 200 volumes, equivalent to more than 100,000 pages of evidence, expert reports, and technical analyses,” he added. “It all began,” he said, “on February 8, 2022, when the state prosecutor’s office received a complaint filed by Fibba against several former state and federal public officials. Among those named are former governors, state secretaries, federal delegates, and trustees, as well as members of the trust’s technical committee.”

Individuals and companies that benefited from illicit operations aimed at improperly appropriating land belonging to said trust were also denounced.

Therefore, during 2023 the breakdown of the investigation was sent to the FGR, which continues with the crimes under its jurisdiction.

Miguel Ángel Navarro Quintero, Governor of Nayarit, said that with the mega-operation, 93 percent of the dispossessed territory has been recovered, “at an average cost equivalent to 50 billion pesos; and if we disregard the undeveloped lands and provide them with public services, it would surely be 100 billion pesos or more.”
