  • If I had to guess, “Murder” is a legally distinct term with a specific definition under the law. Until those responsible are adjudicated in a court of law and found to have committed the legally defined act of murder, what we saw on the video is an alleged murder.

    ETA: AFAIK, there is no Federal Law against murder in any degree, so any conviction or finding of fact that supports a charge of murder would be under state law, and the broad immunity that ICE enjoys has yet to be tested in a courtroom to determine the outer limits of that immunity and whether an administrative body like ICE falls under the same qualified immunity indemnity as regular LEO’s do when they take a life in the line of duty. In other words, any charge of murder would likely be done under MN State laws, and it remains to be seen if ICE would be subject to state laws if they claim that the killing was in line with their official duties.
